Hon’ble Shri Justice Arvind Kumar Verma, Judge Order on Board 15/07/2025
1. By way of the present petition the petitioner has prayed for the following reliefs:
“10.1 That, this Hon’ble Court may kindly be pleased to quash/set-aside the impugned notice
2 dated 17.06.2025 (Annexure P-1) issued by the respondent. 10.2 That, this Hon’ble Court may kindly be pleased to direct the respondent bank to provide reasonable time and opportunity to the petitioner for repayment. 10.3 That, any appropriate writ, direction or order may also kindly be passed in favour of the petitioner, which this Hon’ble Court deems fit in the circumstances of the case.”

Learned counsel for the petitioner submits that the petitioner is challenging the impugned notice dated 17.06.2025 issued by the respondent bank, whereby the petitioner has been granted time for only 7 days to repay the loan amount, failing which the petitioner’s stock will be seized by the respondent bank. Learned counsel gives an undertaking on behalf of the petitioner that the petitioner will repay an amount of Rs. 1 lakh to the respondent bank within 7 days from today and the rest of the outstanding amount will be repaid to the respondent bank within 3 months from the date of receipt of copy of this order. 3. Learned counsel for the respondent bank agreed to the undertaking given by the counsel for the petitioner. 4. Heard learned counsel for the respective parties and perused the record with utmost circumspection. 5. Considering the undertaking given by the counsel for the petitioner, this Court directs the petitioner to repay the an amount of Rs. 1 lakh to the respondent bank within 7 days from today and further directs to repay
3 the rest of the outstanding amount within 3 months from the date of receipt of copy of this order.
The respondent bank is directed not to take any coercive step against the petitioner for the above stated period of 7 days. 6. With the aforesaid direction, the present petition is disposed of. Sd/-
