I.A. No. 14734 of 2025 02/06.12.2025 Heard Mr. Indu Shekhar Gupta, learned counsel for the appellants and learned A.P.P. for the State. This interlocutory application has been preferred by the appellants for condoning a delay of 17 days in filing the appeal. Having been satisfied with the reasons assigned in the instant application, the same is allowed and the delay of 17 days in filing the appeal is hereby condoned. I.A. This appeal is directed against the order dated 26.07.2025 passed in B.P. No. 166 of 2025, arising out of Dumka A.H.T.U. P.S. Case No. 01/2025 by the learned Additional Sessions Judge-II, Dumka, whereby and whereunder, the prayer for bail of the appellants has been rejected. It has been alleged that the informant was taken in the evening of 11.04.2025 by her parents to Kathikund market for purchasing cloths and in course of purchasing she was given cold drink after which she became unconscious and does not remember what happened subsequently. When the door was opened, she had seen the present appellants, her parents and other accused persons and on query she was told that she has been sold for Rs. 2,50,000/- to one Durgesh Singh with whom her marriage has already been solemnized. Submission has been advanced by the learned counsel for the appellants that the appellants have been falsely implicated in this case. It has been submitted that the appellants are not related to the parents of the victim and in fact they were invited to attend the marriage ceremony. It has been submitted that the appellants are in custody since 15.05.2025.
On consideration of the period of custody undergone by the appellants and the fact that the main allegation seems to have been levelled against the parents of the victim as well as one Durgesh Singh, we while setting aside the order dated 26.07.2025 passed by the learned Additional Sessions Judge-II, Dumka in B.P. No. 166 of 2025, arising out of Dumka A.H.T.U. P.S. Case No. 01/2025, direct that the appellants be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) each with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-II, Dumka in connection with Dumka A.H.T.U. P.S. Case No. 01/2025. This appeal stands allowed. (Rongon Mukhopadhyay, J.)
