By virtue of the order dated 06.11.2024, it was made clear that in the event of failure to comply with the condition of depositing 50% of the demanded amount, the interim order would stand vacated automatically and the respondent bank would be at liberty to proceed with the impugned auction. 2 3. Be that as it may, in the absence of compliance of the interim order, it would be open to the respondent bank to proceed further in accordance with the provisions of the Securitisation and Reconstruction of Financial Assets and Enforcement of Securities Interest Act, 2002 (SARFAESI Act). In any case, we do not wish to interfere in the present writ petition in view of the availability of the alternate remedy. 4. Accordingly, the Writ Petition is disposed of. No order as to costs.
