The writ petition has been filed alleging illegal construction at premises no. 21/1, Beliaghat Main Road, Kolkata – 700010. According to the petitioner, the private respondents are carrying on construction over a wakf property. The report filed by the municipality dated 27th November 2025 did not demonstrate any illegal construction, only repair works were noted. 2. Today the municipality has filed a report in respect of premises no.21/1, Beliaghat Main Road, Ward No. 34, Borough – III. As per 2 the above report, it would transpire that on the basis of the inspection carried out on 13th July 2026 it was found that there is a one-storeyed building at the captioned premises wherein two shops and one Agrabani Club is functioning. The copy of the IB record has been disclosed in the report. In the IB records that for the year 1/75-76, 1/87-88 and 1/93-94, a one-storeyed building is recorded in respect of the premises no. 21/1, Beliaghat Main Road, Ward No. 34, Borough – III, and a portion of this one-storeyed building is recorded in favour of Agrabani Club. The above report is countersigned amongst others by the Executive Engineer (C), Building Department, Borough – III, Kolkata Municipal Corporation on 13th July 2026. 3. Having regard to the aforesaid disclosure and considering the previous report dated 27th November 2025 which remains uncontroverted, I am of the view that there is no scope for this Court to direct the municipality to take any further action. In so far as the private disputes between the parties are concerned, it is made clear that this Court has not entered into the disputes, leaving it open to the parties to adjudicate the same in an appropriate forum, if so advised. 4.
