By filing this writ petition, the petitioners herein are praying for grant of Grade-III, IV and V scale as per the provisions of the Bihar (now Jharkhand) Elementary School Teachers Promotion Rules, 1993. It is the case of the petitioners that they possessed all requisite qualifications but the aforesaid grade has not been granted to the petitioners who are in the District of Seraikella- Kharsawan. 3. It is the grievance of the petitioners that similarly situated Teachers who are serving in the district of Singhbhum East and Singhbhum West which are neighboring district are being granted benefits but the petitioners and other similarly situated persons in the district have been left out. He contends that the department had sought for several documents and all the petitioners have deposited the same way-back in 2023 but no decision has been taken. 4. Learned counsel appearing on behalf of the State submits that there is nothing on record to suggest that all the petitioners (47 in numbers) deposited their respective documents. It is his contention that in the rejoinder also the petitioners have never stated that all these 47 petitioners have deposited the documents. 5. Be it noted that since the matter is before the respondents, I direct the Deputy Commissioner, Seraikella-Kharsawan to ensure that the case of all the petitioners and other similarly situated Teachers be looked into so far as it relates to grant of Grade III, IV and V is concerned. Establishment Committee who is the competent authority will consider the case of the Teachers who had 2025:JHHC:34373 7 furnished all their documents. 6. On consideration of all the documents if it is found that the petitioners are entitled for the relief, the same to be extended to them. The petitioners should bring to the notice of the Deputy Commission about this Order and also file a representation. Along with the representation they will annex all the documents which supports the claim of the petitioners. Once these fresh representations are filed, the matter will be forwarded to the Establishment Committee of the District who will consider each individual case of the petitioners and pass appropriate order. 7. If it is found that any of the petitioners are entitled for any relief as prayed for, the same should be extended to them immediately including the monetary benefit and the consequential benefit. If any prayer of the petitioners is rejected, a reasoned order should be communicated to them. 8. The petitioners are expected to file representation within three weeks along with all the necessary documents. The respondents will decide the individual claims within 12 weeks thereafter and will communicate the results to each of the petitioners. It is expected that the benefit to the eligible persons should be extended within two weeks thereafter. 9. With the aforesaid observation and direction, this writ application is disposed of. 10. I.A.
