Rakesh Kainthla, Judge (oral) In compliance to the order 23.02.2026, learned counsel for the petitioner has placed on record a receipt regarding the deposit of ₹9000/-, which is 7.5% of the cheque amount of ₹1,20,000/-, issued by the Member Secretary, H.P. Legal Services Authority, Kasumpti, Shimla, District Shimla, H.P. 2. Yes. 2 want to proceed further with the complaint in view of the compromise effected between the parties. 3. In view of above, present revision petition is allowed and the judgment passed by learned Sessions Judge, Hamirpur, H.P. in Cr. Appeal No. 68 of 2009, dated 10.12.2024 (learned Appellate Court) affirming the judgment of conviction dated 30.09.2009 and order of sentence dated 26.10.2009, passed by Judicial Magistrate, First Class, Court No.I, Hamirpur, H.P. (learned Trial Court) passed in Private/Criminal Complaint No. 29-I-2007 are ordered to be set aside and the complaint is dismissed as not pressed. 4. Learned counsel for the petitioner submits an amount of ₹74,000/-has been deposited before the Registry of this Court, which is to be disbursed to the complainant as per the compromise. Hence, the amount of ₹74,000/- deposited before the Registry of this Court is ordered to be disbursed to the complainant under proper identification and receipt by remitting the amount to the savings account of complainant on furnishing of bank details, if not furnished earlier. 3 5.
