This is an application under section 483 of B.N.S.S. in connection with O.I.C., Hinjilicut Excise Station, Ganjam P.R. Case No.07/2025-26 corresponding to 2(a) CC Case No. 05 of 2025(N) pending before the 1 learned Addl. Sessions Judge -cum- Special Judge, Chhatrapur, Ganjam for the offence under section 20(b)(ii)(B) of the N.D.P.S. Act. The prayer for bail of the petitioner has been rejected by the learned Addl. Session Judge -cum- Special Judge, Chhatrapur, Ganjam vide order dated 26.04.2025. Considering the submissions made by the learned counsel for the petitioner that the petitioner is in judicial custody since 24.04.2025 and the contraband ganja stated to have been recovered from the possession of the petitioner is 4 kg. 500 grams which is lesser than commercial quantity and therefore, the bar under section 37 of the N.D.P.S. Act is not applicable, the investigation of the case has made substantial progress and on hearing the learned counsel for the State, I am inclined to release the petitioner on bail. Let the petitioner be released on bail in the aforesaid case on furnishing a bail bond of Rs.50,000/- (rupees fifty thousand) with two solvent sureties each for the like amount to the satisfaction of the learned trial Court with further conditions that the petitioner shall not indulge in any criminal activities and shall appear before the learned trial Court on each date to which the case would be posted for trial. Violation of any of the conditions shall entail cancellation of bail. The BLAPL is accordingly disposed of. Issue urgent certified copy as per Rules. ( S.K. Sahoo) Judge PKSahoo
