State Of Rajasthan, Through Inspector General, Prison, Jaipur. 2. The District Collector, Dudu (Raj.) 3. The Superintendent, High Security Jail Ajmer. ----Respondents For Petitioner(s) : Mr. Govind Prasad Rawat For Respondent(s) : Mr. Rajesh Choudhary, GA-cum-AAG with Mr. Aman Kumar, AAAG Mr. Gaurav Gupta, Assistant Govt. Advocate HON'BLE MR. JUSTICE PANKAJ BHANDARI HON'BLE MRS. JUSTICE SHUBHA MEHTA Order 10/01/2025 1. Petitioner through his brother has preferred this Criminal Writ Petition (Parole) seeking first regular parole for a period of 20 days and for quashing & setting aside the order dated 09.09.2024, qua the petitioner. 2. It is contended by learned counsel for the petitioner that petitioner has remained in custody for a period of six years. His first regular parole was rejected on the ground that petitioner has been given jail punishment on 04.11.2022. It is also contended (2 of 2) [CRLW-2083/2024] that the only requisite condition for grant of first regular parole is his conduct in jail. The report submitted by the jail authorities with regard to conduct mentions that conduct of the petitioner is satisfactory. 3. Learned GA-cum-AAG has opposed the writ petition(parole). 4. We have considered the contentions. 5 The parole application was rejected on 09.09.2024 i.e. after about two years of the jail punishment. At the time when application was rejected, the conduct of the petitioner in jail was satisfactory. Hence, the reason assigned for rejection cannot be sustained, hence, we deem it proper to allow the present criminal writ petition and set aside the order dated 09.09.2024, qua the petitioner. 8. Thus, Criminal Writ Petition (Parole) is allowed. The order passed by the District Magistrate, Dudu dated 09.09.2024 qua the petitioner is quashed and set aside. The Jail Authorities are directed to release the petitioner on first regular parole for a period of 20 days on furnishing of his personal bond of Rs.50,000/- with two sureties of like amount to the satisfaction of the Superintendent, High Security Jail Ajmer, with the stipulation that he shall surrender himself before the Jail Authorities on the expiry of parole period and shall maintain peace and tranquility during parole period. 9. In case of failure to surrender by stipulated date, the Jail Authorities shall proceed in accordance with Law. (SHUBHA MEHTA),J (PANKAJ BHANDARI),J HEENA/29
