JUSTICE MRIDUL KUMAR KALITA ORDER 11.05.2026 [1] Heard Mr. S.K. Goswami, the learned counsel for the applicant. Also heard Mr. M. Khan, the learned counsel appearing for respondent Nos. 1,2 and Page No.# 3/4 3/claimants. [2] This interlocutory application has been filed by the applicant/insurance company praying for condonation of 20 days in filing the connected MACAppeal. [3] The learned counsel for the respondent Nos. 1, 2 and 3/claimants submits that he does not have any objection if the prayer for condonation of delay is allowed. [4] It also appears from the Office Note that the respondent No. 4 has expired and the notice issued to respondent No. 5 has not yet returned. [5] The learned counsel for the applicant submits that since the claimants does not have any objection against the prayer for condonation and since the connected appeal is basically against the quantum of the compensation granted to the claimants, hence, notice to other respondents may be waived. [6] The prayer is allowed. [7] I have gone through the grounds of delay stated in the instant interlocutory application. [8] Considering the grounds stated therein to be sufficient cause which prevented the applicant from preferring the appeal within the prescribed period of limitation, the delay of 20 days in preferring the connected appeal is hereby condoned and this Page No.# 4/4 interlocutory application is allowed. [9] Let the connected MACAppeal be registered by the Registry and list the same for admission on 15th June, 2026. [10] The name of Mr. M.
