It is the case of the petitioners that they are entitled for the benefit of 3rd M.A.C.P. as per the Circular of the Department as contained in Memo No.6/,l0-06(izks)-03/2009-2981/fo0 dated 01.09.2009. 3. Learned counsel representing the petitioners submits that a representation has already been filed but the respondent – department is yet to take any action. 4. Learned counsel representing the respondent – State submits that the petitioners should first approach the appropriate Authority and if they are entitled to, their case will be considered. 5. After hearing the parties, I find that the petitioner is seeking benefit of 3rd M.A.C.P., pursuant to Circular dated 01.09.2009. In these type of matters, the entitlement of the petitioners has to be decided at the first instance, along with the applicability of the Circular, so far as these petitioners are concerned. Further, a representation is already pending. 6. Considering the aforesaid facts, the petitioners are directed to file their fresh individual application / representation before the Principal Secretary, Department of Agriculture, Animal Husbandry and Cooperative, Government of Jharkhand, along with all the documents and the Circular, which they rely upon, within four weeks. 6.1. The respondents thereafter will consider the case of the petitioners, in consultation with the Principal Secretary, Department of Finance, Government of Jharkhand, within ten weeks thereafter, and will take appropriate steps as per the reasoned order within a 2025:JHHC:31713 3 further period of two weeks. 6.2. If it is found that the aforesaid Circular is applicable to the petitioners and the petitioners are entitled for benefit of the 3rd M.A.C.P., the same should be granted to them, after following the procedures. 6.3. In alternative, if it is found that the petitioners are not entitled for the benefit and if the Circular is not applicable, the reasons thereof should be communicated to the petitioners. 7.
