PUBLIC PROSECUTOR (AP) The Court made the following: ORDER: This Criminal Petition is filed under Section 482 Cr.P.C., seeking to quash the proceedings in FIR.No.259 of 2021, on the file of Rajam Police Station, Srikakulam District. 2. When the petition came up for hearing on 16.12.2021, this Court has passed the following order: “Having regard to the specific allegations ascribed in the F.I.R. against the petitioner, this Court is of the considered view that the matter requires investigation to find out the truth or otherwise of the allegations set out in the F.I.R. against him. Therefore, the investigation cannot be interdicted. However, as the offences registered against the petitioner are punishable with less than seven (07) years period of imprisonment, the Investigation Officer is directed to follow the procedure contemplated under Section 41 A Cr.P.C.” 3. Today when the petition is taken up for hearing, learned Assistant Public Prosecutor on oral instructions has informed this Court that in view of the order passed by this Court on 16.12.2021, the Police have proceeded with the investigation, but, till date, no charge sheet has been filed and requested time to file the same. 4. In view of the fact that the investigation in the present case was not stalled by this Court and as no charge sheet has been filed till date, the Police are directed to file a charge sheet in the present petition after completion of the investigation as expeditiously as possible, preferably within a period of eight (8) weeks from the date of receipt of a copy of this order. Till such time, the Police are directed not to take any coercive steps against the petitioner. 5. Accordingly, this criminal petition is disposed of.
