(Accused Is Presently Confined In District Jail, Dholpur). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Manoj Kumar Awasthi For Respondent(s) For Complainant(s) : : Mr. N.S. Dhakar, PP Mr. Ishan Mishra Ms. Rashmi Meena HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 21/01/2025 1. The instant bail application has been filed under Section 483 of BNSS on behalf of the petitioner, who has been arrested in connection with FIR No.187/2024 registered at Police Station Nihalganj, District Dholpur (Rajasthan) for the offences punishable under Sections 143, 302, 379, 120B & 201 of IPC. Later on, police filed charge-sheet in this matter for the offences punishable under Sections 302, 201 & 120B of IPC. 2. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Counsel submits that petitioner is a female. Counsel submits that dead body of the deceased has not been recovered from the house of the petitioner. Counsel submits that only on the basis of surmises and conjunctures she has been roped in this case. Counsel further submits that there are no criminal antecedents of the petitioner. [2025:RJ-JP:4308] (2 of 2) [CRLMB-14366/2024] Petitioner is in custody since 01.09.2024 and trial will take considerable time. Further custody of the petitioner would not serve any fruitful purpose. 3. Learned Public Prosecutor assisted by learned counsel for the complainant vehemently opposes this bail application. They submit that the blood stained cot has been found in the house of the petitioner. 4. Heard and Perused. 5. As per the prosecution case, main allegation of murdering Anand Sharma is against the accused-petitioner Gudia with whom the deceased was having relationship. The deceased engaged with another girl and on this issue, the petitioner became annoyed with the deceased and murdered him. Further as per the prosecution case, witnesses namely Satish, Bhagwati Prasad and Ashish saw the deceased lastly entering in the house of the petitioner. Thus, looking the gravity of offence and nature of allegations attributed to the accused petitioner, I am not inclined to enlarge the petitioner on bail. 6. However, the observation made hereinabove is only decision of this bail application and would not have any impact on the trial of the case. (ANIL KUMAR UPMAN),J LALIT MOHAN /128
