2. Petitioner has been made accused in connection with Deoghar (Cyber) P.S. Case No. 81 of 2025 for the offences registered under Sections 319(2), 318(4), 338, 336(3), 340(2) and 61(2) of the B.N.S., 2023, and Sections 66B, 66C, 66D and 84C of the I.T. Act, pending in the Court of learned Additional Sessions Judge-II-cum-Special Judge, Cyber Crime, Deoghar.
3. On 15.05.2025, Cyber Police Deoghar, on the basis of confidential information raided a place near Raidih forest and apprehended the petitioner and co-accused person. It is alleged that petitioner and co-accused were committing cyber offence.
4. It was further submitted that a mobile phone is alleged to have been recovered from the possession of the petitioner. It appears that the statement of the victim namely M. Hari Prasad was recorded during investigation. The victim has stated that the mobile phone which was recovered from the possession of the petitioner was used in cheating him on 20.05.2024. It was further submitted that at the time when call was made to the victim, petitioner was already in judicial custody. It was further submitted only on this ground, learned trial court has granted bail to five accused persons.
5. In view of the submission made above, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Cyber Crime, Deoghar, in connection with Deoghar (Cyber) P.S. Case No. 81 of 2025.
