Sri Rajeev Chaddha, Advocate appears and submits that the accused/applicant has been falsely implicated in G.T. No.252 of 2010, arising out of Case Crime No. 1555 of 2009, under Section 2/3 Gangster Act, Police Station Kotwali, District Gorakhpur. 2. Learned counsel for the accused-applicant, contends that there is criminal history of ten cases against the accused-applicant, which is duly explained in the bail application as well as supplementary affidavit. The explanation of criminal history shows that in two cases, the accused is acquitted; in six cases bail has been granted; one case of Section 110 Cr.P.C. has been dropped and in one case, no charge sheet has been submitted. As such, he prays that the accused/applicant be enlarged on bail. 3. Learned A.G.A. has opposed the prayer for bail but could not dispute the aforesaid facts. 4. This Court has taken into consideration the rival submissions made by learned counsel for the parties and perused the records which prima facie reveals that there are three cases shown in the gang-chart. The accused is acquitted in two cases and bailed out in the third. No conviction is recorded in any case as per available record. The applicant is in jail since 30.01.2025. 5. As such the bail application is allowed. 6. The accused/applicant- Rajan Pahadi be released on bail in the aforesaid case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of court concerned.
