By way of this petition, the petitioner is seeking for the following relief:- “a. Learned counsel for the petitioner submits that the petitioner is the director of Roadstar Fleets Pvt. Ltd., situated at 405 BDN Tower Main Road Kota Raipur District Raipur, the work of the petitioner's firm is transporting of iron quails to the company of respondent no.3. As per the work order/ agreement NA dated 08.12.2022, the petitioner's company has supplied the goods in the company of respondent no. 3 in invoice number RF/FCM/24-25/0190 dated 03.07.2024 but the respondent no. 3 did not disbursed the amount, therefore the petitioner has filed the application no. UDYAM-CG-14-0032439/M/00002 as per the section 18(1) of the Micro Small and Medium Enterprises Development Act 2006 which is pending since 03.09.2024 but the till date no final order has been passed by the respondent no. 2. Hence he prays for a direction to the respondent no. 2 to decide the application no. UDYAM-CG-14- 0032439/M/00002 filed by the petitioner which is pending since 03.09.2024 within stipulated period. 3. Learned State Counsel submits that in view of the limited prayer made by the learned counsel for petitioner seeking direction to respondent- authorities to consider the application, she is having no objection to the limited prayer and if the application dated 03.09.2024 of the petitioner is pending, it will be considered in accordance with law. 4. I have heard learned counsel for the parties and perused the material available on record. 5. Section 18, subsection (5) of the Micro, Small and Medium Enterprises Development (MSMED) Act, 2006, specifies that any reference to the Micro and Small Enterprises Facilitation Council (MSEFC), the MSEFC must decide on the reference within 90 days from the date it was made. 6. Considering the facts and circumstances of the case instead of keeping this petition pending, I find it appropriate to dispose of the same at this stage directing the respondent No. 2 to consider/decide the application bearing no. UDYAM-CG-14- 0032439/M/00002 dated 03.09.2024 of the petitioner on its own merits within an outer limit of 90 days from the date of receipt of copy of this order. 7. It is made clear that this Court has not observed anything on the merits 3 of the case. 8. With the aforesaid direction, the writ petition is disposed of.
