Being aggrieved by the order passed by the Appellate Authority as well as by competent authority, the petitioner- [2025:RJ-JP:37302-DB] (2 of 2) [SAW-40/2024] appellant filed writ petition before the learned Single Judge after a delay of nine years and the same was dismissed by the learned Single Judge vide order dated 24.08.2023 and observed as under:- “7. I have heard the learned counsel for the petitioner and the perused the material available on record. 8. This Court finds that the review petition of the petitioner was decided and dismissed by order dated 29.08.2008 and the instant petition has been filed in the year 2017, there is no explanation of such inordinate delay being caused and as such, the petition suffers from laches and delay. 9. This Court, on the merits of the matter, finds that the misconduct which was committed by the petitioner, though of serious nature, however, only minor penalty was imposed with stoppage of two annual grade increment without cumulative effect and as such, the Authority taken a lenient view and imposed minor penalty. 10. This Court finds that the punishment which has been imposed does not require any interference, as the same has also been examined by both the Appellate Authority as well as the Reviewing Authority. 11. Accordingly, the present writ petition lacks merit and as such, the same stands dismissed.” After going through the record, We are in complete agreement with the view taken by the learned Single Judge that the petitioner has filed writ petition after a delay of nine years after passing of the final order and no cogent reasons have been assigned for the delay. In that view of the matter, this special appeal stands dismissed. (BHUWAN GOYAL),J (INDERJEET SINGH),J JYOTI /198
