The petitioner has filed the present writ petition with the following prayer: “a. This Hon'ble Court may kindly be pleased to issue a writ in the nature of mandamus or suitable direction to the respondents for grant of appointment on the post of Technician [Pathology] T&S Grade-C from the date 06/10/2023 when the similar situated candidates were given appointment on the post. b. This Hon'ble Court kindly be pleased to allow the seniority, pay scale and other consequential benefits as granted to the other similar candidates w. e. f. 06.10.2023. c. This Hon'ble Court kindly be pleased to award the monetary compensation Rs. 5 Lakh to the petitioner for discriminatory action and mental agony pain. d. To allow any other relief as the Hon'ble Court may be deemed fit and proper. e. May kindly be pleased to allow the cost of petition.” 2. Learned counsel for the petitioner restricted his submissions that the matter pertains to appointment of the petitioner on the post of Technician (Pathology) T & S Grade-C and despite she secured position in the list of eligible candidates she has not been provided appointment for which she made her representation on 05.04.2025 to the respondent No.6 which is still pending for its consideration and no decision has been taken on her representation. The submissions of her representation has also been reflected from the documents (Annexure P/12) which is the communication from the respondent department, the 3 petitioner, therefore, the respondent No.6 may be directed to take a decision on the pending representation of the petitioner dated 05.04.2025 (Annexure P/11) within the stipulated time frame. 3. On the other hand, learned counsel for the respondents would submit that they have no objection, if such a direction is being made to decide the pending representation of the petitioner dated 05.04.2025 within stipulated time frame in accordance with law. 4. I have heard learned counsel for the parties and perused the material annexed with the petition. 5. Considering the limited submissions made by learned counsel for the petitioner with respect to the consideration of her representation dated 05.04.2025, the respondent No. 6 is directed to take a decision on the pending representation of the petitioner dated 05.04.2025 (Annexure P/11) within 04 months from the date of receipt of copy of this order in accordance with law on its own merits. 6. The petitioner is directed to produce a copy of this order to the respondent No.6 within two weeks from today. 7. With the aforesaid observation, the present writ petition is disposed of.
