The petitioner is apprehending his arrest in connection with Giridih (T) P.S. Case No. 240 of 2019, registered for the offences under Sections 420, 409, 102-B and 34 of the Indian Penal Code, pending in the court of learned C.J.M., Giridih. 3. Learned counsel appearing for the petitioner submits that the allegation of the present case has already been investigated by the CBI in R.C. Case No. 10-A/2019(D) and chargesheet has also been submitted. He submits that for the same transaction, the present FIR has been lodged by the District Police, Dhanbad. He next submits that in the CBI case, the petitioner has co-operated in the investigation and he has been provided the privilege of anticipatory bail in A.B.A. No. 3798 of 2024 by this court. He then submits that by the earlier order, the case diary was called for and in para-47 thereof, the transaction is shown, which is similar to the investigation made by the CBI in the earlier case. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that CBI has further investigated the case and has [2025:JHHC:33073] -2- found that the defalcation has been made by the petitioner to the tune of Rs. 2 crores and odd. 5. In view of the above and looking into the contents of the present FIR and the contents of R.C. Case No. 10-A/2019(D), wherein the petitioner has co-operated in the investigation and he has been provided the privilege of anticipatory bail in A.B.A. No. 3798 of 2024 by this court and further in light of the statements made in para-47 of the case diary, it transpires that the transaction is same, I am inclined to provide privilege of anticipatory bail to the petitioner. 6. Accordingly, the petitioner, named above, is hereby directed to surrender before the learned court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned C.J.M., Giridih, in connection with Giridih (T) P.S. Case No. 240 of 2019, subject to the conditions as laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Dated:-04.11.2025 Amitesh/-
