Order 18/03/2025
1. Apprehending their arrest in connection with FIR No. 350/2021 registered at Police Station Jurhara, District Bharatpur for the offence(s) under Section 306 of IPC, the petitioners have preferred this anticipatory bail application under Section 482 BNSS.
2.
Learned counsel for the accused-petitioners submits that petitioners have falsely been implicated in this case. It is argued that petitioners and complainant have entered into compromise. He further submits that custodial investigation of the accused
[2025:RJ-JP:12234] (2 of 3) [CRLMB-14369/2024] petitioners is not required and petitioners are ready and willing to cooperate with the investigation. There is no evidence to the fact available on record indicating that petitioners instigated the deceased to commit suicide. She prays that the anticipatory bail of accused-petitioners may be allowed.
3. Learned Public Prosecutor vehemently opposes the bail application.
4.
Learned counsel for the complainant concedes that petitioners and complainant have arrived at compromise and if the anticipatory bail application of the accused-petitioners is allowed then complainant has no objection.
5. I have considered the overall allegations levelled in the FIR and contentions made by the counsel for the parties.
6. FIR itself is delayed by almost 2 months and custodial investigation of the accused petitioners is not required. There are no criminal antecedents against the petitioners and petitioners are ready and willing to cooperate with the investigation, without expressing anything on merits of the case, I deem it just and proper to allow the anticipatory bail application of the accused- petitioners.
6. Accordingly, the anticipatory bail application under Section 482 BNSS is allowed and it is ordered that in the event of arrest of the petitioners- 1. Soniya @ Banto D/o Shri Puran, 2. Puran S/o Shri Fauza Singh, 3. Krishna W/o Puran, in connection with FIR No.350/2021 registered at Police Station Jurhara, District Bharatpur, they shall be released on bail, provided each of them furnish a personal bond in the sum of Rs.50,000/- with two
[2025:RJ-JP:12234] (3 of 3) [CRLMB-14369/2024] sureties in the sum of Rs.25,000/- to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:- (i) that the petitioners shall make themselves available for interrogation by a police officer as and when required; (ii) that the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and (iii) that the petitioners shall not leave India without previous permission of the court.
