This application is filed on behalf of the Petitioner under Section 151 of CPC seeking condonation of delay of one day in refiling the present petition. 2. For the reasons stated in the application, the same is allowed. Delay of one day in refiling the present petition is condoned. 3. Application stands disposed of. O.M.P. (T) (COMM.) 145/2024 4. This petition is filed under Sections 14 and 15 of the Arbitration and Conciliation Act, 1996 (‘1996 Act’) seeking termination of the mandate of Ms. Monica Malhotra, Advocate on the ground that the learned Arbitrator has recused herself on 06.08.2024 as also for appointment of a substitute Arbitrator. Learned counsel for the Respondent fairly submits that Respondent has no objection to appointment of a substitute Arbitrator. 6. Accordingly, with the consent of the parties, Mr. Gaurav Goyal, Advocate (Mobile No.9899886074), is appointed as the substitute Arbitrator to adjudicate the disputes between the parties. Arbitral proceedings will resume from the stage at which they were left by the erstwhile Arbitrator. Fee of the Arbitrator shall be fixed as per Fourth Schedule of 1996 Act. 7. Learned Arbitrator shall give disclosure under Section 12 of the 1996 Act before entering upon reference. 8. It is made clear that this Court has not expressed any opinion on the merits of the case and all rights and contentions of the respective parties are left open. 9.
