Order No:-02 Dated-05-12-2025
Heard the parties.
The petitioner has been made accused in connection with Sakchi P.S. Case No.236 of 2024 corresponding to G.R. Case No.318 of 2025 registered under Sections 318 (2), 338, 336 (2), 3 (5) of the B.N.S., 2023.
Learned senior counsel for the petitioner submits that this is the second journey of the petitioner with the prayer for regular bail of the petitioner as the prayer for bail of the petitioner was earlier rejected vide
order dated 10.07.2025 by this Court but by that time only one witness was examined and the fresh ground is that in the meanwhile two more witnesses have been examined and all of them have stated about the offence being committed by the co-accused Keshav Kumar Singh and there is no direct or specific allegation made against the petitioner. It is further submitted that the allegation against the petitioner is false. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case. It is lastly submitted that the petitioner has been in custody since 23.12.2024 as is evident from para-21 of the instant bail application. Hence it is submitted that the petitioner be released on bail.
Learned Addl. P.P. opposes the prayer for bail.
Considering the facts of this case, the above-named petitioner is
directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate at Jamshedpur in connection with Sakchi P.S. Case No.236 of 2024 corresponding to G.R. Case No.318 of 2025 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case.
