Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents. 2. Present petition has been filed for the following reliefs : I) Issue a writ, order or direction in the nature of mandamus directing/commanding the respondent no. 4 to decide the application dated 09.11.2024 under Section 147 of U.P. Municipality Act, 1916. II) Issue any other writ, order or direction, which this Hon'ble Court may deem fit and proper under the facts and circumstances of the present case. III) To award the cost of writ petition. 3. The grievance of the petitioner is that the petitioner has submitted an application for including his name in the assessment list of Nagar Palika on 09.11.2024 but the respondent no. 4 has not paid any heed to the aforesaid representation. 4. No useful purpose would be served in keeping the writ petition pending as the Executive Officer has to decide about the incorporation of the name in the assessment register. 5. Accordingly, the writ petition is disposed of permitting the petitioner to file a fresh application u/s 147 of U.P. Municipalities Act, 1916 along with earlier application enclosed as Annexure No. 3 within a period of one month before the respondent no. 4. 6. In case, any such application is filed by the petitioner, the respondent no. 4 shall consider and decide the same in accordance with law after giving due notice and opportunity of hearing to all the concerned parties within a period of two months from the date it receives the representation of the petitioner.
