This is First bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant arrested in connection with Crime No.77/2025 registered at Police Station – City Kotwali, District – Mungeli (C.G.) for the offence punishable under Sections 111, 311(2), 317(4), 317(5) & 3(5) of BNS. 2. As per prosecution story in brief is that on 02.03.2025, upon the application received by the Cyber Cell Mungeli, through the Indian Cyber Crime Coordination Portal operated by the Ministry of Home Affairs, Government of India, for action against various mule VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.07.22 20:22:37 +0530 2 account holders (as per the information collected in the coordination portal of the Indian Cyber Crime Coordination Center) cyber fraud has been committed from various bank branches in District Mungeli, totaling an amount of 5,76,648. ₹ The funds obtained through cyber fraud were used by the bank account holders/related individuals, in which a total fraudulent amount of 5,76,000 was found deposited in various bank accounts from 01-01-2024 to 28-02-2025. On discovering the involvement of 22 such unidentified account holders and related persons, Crime No. 77/2025 was registered at Police Station City Kotwali Mungeli under Sections 111, 317(2), 317(4), 317(5), and 3(5) of the B.N.S. & the matter was taken up for investigation. During the investigation, the statements of the account holders were recorded, and the applicant/accused Sanjeev Jangde, along with other accused persons Ishwar Singh and Sewakram Sahu, were arrested on 21.03.2025. 3. Learned counsel for the applicant submits that the present applicant has been falsely implicated in this case. The applicant is in jail since 21.03.2025, chargesheet has been filed and trial is likely to take some time. Therefore, she prays that the present applicant is entitled for grant of regular bail. 4. On the other hand, the learned State counsel opposes the bail application and submits that the charge-sheet has been filed in the present case before the competent Court. He further submits that the present case is of the nature of online fraud as the present applicant has given his bank account Number, Aadhar card, ATM Card and mobile Number to the upper layer person who 3 was involved in the said fraud and due to which, the online fraud was committed by the accused persons and the complainant has suffered of huge amount 1.e. 1 Crores 30 lakhs and as such, the applicant is not entitled to be released on bail 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. From perusal of the case diary, it transpires that the present applicant has given his bank account Number, Aadhar card, ATM Card and mobile Number to the upper layer person who was involved in the said fraud and due to which, the online fraud was committed by the accused persons and the complainant has suffered of huge amount i.e. 1 Crores 30 lakhs, therefore, I am not inclined to grant bail to the present applicant. 7. Accordingly, the bail application of the applicant Sanjeev Janghde, involved in Crime No.77 of 2025 registered at Police Station City Kotwali, Mungeli, District- Mungeli (C.G.), for the offence punishable under Sections 111, 311(2), 317(4), 317(5) & 3(5) of Bhartiya Nayay Sanhita is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
