1. Heard learned counsel for the petitioner and the learned Assistant Government Pleader appearing for respondents. th
2. Petitioner is aggrieved by the unilateral action of the 4 respondent in interfering with the business of the petitioner. The petitioner has obtained permission for running a medical shop and the 3'^'^ respondent issued show cause notice on 15.07.2025 calling upon the petitioner to submit explanation with regard to certain irregularities allegedly noticed in the petitioner’s medical shop. The petitioner submitted reply on \ th
20.07.2025.
It is submitted that the petitioner was directed by the 4 respondent not to open the shop while serving the show cause notice and, accordingly, the petitioner closed the shop till 09.08.2025 and later on, the 4^^ respondent himself again permitted the petitioner to re-open the shop. It is further submitted that the 4*^ respondent has now started approaching the petitioner and directing the petitioner to close the shop without issuance of any notice. 3.
Learned counsel for the petitioner submits that a detailed explanation was submitted duly informing the 4*^^ respondent that the petitioner has not violated any of the provisions of the Drugs and Cosmetics Act, 1940. As such there was no occasion for the 4*'^ respondent to take any action in terms of the provisions of the Drugs and Cosmetics Act, 1940 against the petitioner’s shop.
4. Learned Assistant Government Pleader appearing for per his oral instructions, there is no interference of the respondents in the business of the petitioner. Recording the same, the writ petition is disposed of making not to disturb the business activity of the process. respondents submits that as it clear to the respondents petitioner without following due
