THE HON’BLE SRI JUSTICE K. SREENIVASA REDDY CRIMINAL APPEAL NO. 1136 OF 2008
JUDGMENT:
Originally, a private complaint has been filed by the appellant against 1st respondent for the offence punishable under Section 138 of the N.I. Act, vide C.C.No.655 of 2004 on the file of the Judicial Magistrate of First Class, Kurnool. By its judgment, dated 17.03.2006, the accused was found guilty of the offence under Section 138 of the N.I.Act, accordingly convicted of the said offence and sentenced to undergo Simple Imprisonment for a period of one year and to pay a fine of Rs.1,15,000/-, in default of payment of fine, to undergo simple imprisonment for a period of three months and out of fine amount of Rs.1,10,000/- was ordered to be paid to the complainant towards compensation.
2. Against the said conviction and sentence, the accused preferred an appeal vide Criminal Appeal No. 41 of 2006 on the file of the I Additional District & Sessions Judge, Kurnool. By its judgment dated 20.02.2008, the appellate court allowed the appeal by setting aside the conviction and sentence passed against the appellant therein by the trial court in C.C.No.655 of 2004, dated 17.03.2006 and the fine amount, if any, paid was ordered to be returned to the accused after expiry of the appeal time. Aggrieved thereby, the complainant has filed the present appeal.

Today when the matter is taken up for hearing, a memo has been filed by the counsel appearing on behalf of the appellant stating that the appellant died on 30.11.2023 leaving behind his wife as his sole legal heir to succeed his estate, and further stated that the family of the appellant expressed their disinterest in pursuing the appeal.
Learned counsel for the appellant filed copy of Death Certificate of the appellant herein.
4. Recording the said submission, the Criminal Appeal is closed. Consequently, miscellaneous petitions, if any, pending in the Criminal Appeal shall stand closed.
