Judgment On Board 30-04-2025 Heard on admission. 1) By way of this petition, petitioner has sought following relief(s):- 10.1 That this Hon'ble Court may kindly be pleased to issue an appropriate writ, thereby directing the respondent authorities to issue
2 relevant revenue documents in favour of petitioner including Kissan Kitab in respect of land bearing old khasra no. 19/11 (new number 169) situated at Village Bhilai, P.H.No. 147, Tahsil-Arang, District-Raipur (C.G.). 10.2 That any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the cost of the petition may be given. 2) Learned counsel for the petitioner submits that a compromise award was passed in Civil Suit No.299A/2018 by Seventh Civil Judge-Class-II, Raipur in National Lok Adalat held on 09.03.2019 whereby plaintiff- petitioner was declared the owner of land bearing Khasra No. 19/11 (new Khasra No. 169) ad-measuring 0.05 hectare situated at Village- Bhilai, Tehsil Arang, District- Raipur. 3) Learned counsel for the petitioner submits that petitioner approached the revenue authorities for issuance of Kisan Kitab and other revenue documents pursuant to compromise decree passed in National Lok Adalat dated 09.03.2019 but till date, no action has been taken. 4) On the other hand, learned State counsel submits that if petitioner makes a representation before the concerned authority, appropriate decision would be taken. 5) Heard. 6) Evidently, a compromise decree was passed way back on 09.03.2019 whereby petitioner herein was declared the owner of land bearing Khasra No. 19/11 (new Khasra No. 169) ad-measuring 0.05 hectare situated at Village-Bhilai, Tehsil Arang but till date, revenue authorities have not issued Kisan Kitab and other revenue documents. Admittedly, Commissioner, Division Raipur has also passed order in favor of petitioner on 11.10.2019 and direction was issued to provide necessary
3 documents to petitioner within period of 15 days but till date, same has not been complied. There is no reason for the respondent authorities to not issue the aforementioned documents in favor of petitioner when compromise decree has already been passed in favor of petitioner. 7) Taking into consideration the above-discussed facts, this petition is hereby being disposed of reserving liberty in favor of petitioner to make a representation within period of 15 days before the Naib Tahsildar, Arang, who in turn is directed to take appropriate steps within further period of 30 days.
8) In the present case, despite a compromise decree was passed by the National Lok Adalat in favor of petitioner on 09.03.2019 and a specific
order was passed by the Commissioner, Division Raipur on 11.10.2019, respondent authorities failed to issue Kisan Kitab and revenue documents to the petitioner and thus compelled him to prefer this petition. Therefore, respondent authorities are directed to make payment of compensation to the tune of Rs. 25,000/-, payable to the petitioner within period of 60 days from the date of receipt of copy of this order. 9) With the aforesaid observation(s) and direction(s), this petition stands
