Since the date of grant of patta, the said individual was in peaceful possession and enjoyment of the said land. Subsequently, the land got sub-divided and it was assigned with Sy.No.170/2B2, thereafter the name of the original assignee was mutated in revenue records and he was also issued pattadar passbooks and title deeds. It is further case of the petitioner that he purchased the said property from the legal heirs of original assignee Sri' K. Venkata Rama Naidu through registered sale deed dated 02.03.1996 vide document No. 1060 of 1996. Since the date of purchase, he claims that he is in peaceful possession and enjoyment of the said property. It is further stated that, his name is also mutated in revenue records and he was issued pattadar passbooks and title deeds. Though the 2 respondent called for a report from the 3'^'^ respondent, on perusal of the impugned endorsement it is clear that the 2^^ respondent did not take into consideration of the same while issuing the endorsement. On the contrary, the 2^^ respondent rejected the claim of the petitioner stating that originally the subject land is nd classified as ‘Cheruvu Thottu’. On a perusal of the report submitted by the 3'^'^ respondent, it is clearly stated that the land was assigned in favour of the vendor of the petitioner, whereas the impugned endorsement was passed stating that originally the subject land is classified as “Cheruvu Thottu”, without assigning any reason. In the absence of any material to show that the subject land is originally classified as ‘Cheruvu Thottu the impugned endorsement does not stand for judicial scrutiny.
