The Court made the following Order: Heard learned counsel for the petitioner. 2. The present Revision Petition is filed seeking a direction for disposal of A.S.No.65 of 2023 on the file of the Court of VII Additional District Judge, Kakinada under Article 227 of the Constitution of India. 3. The respondent in the above said appeal is the plaintiff in O.S.No.19 of 2022 on the file of the Court of Senior Civil Judge, Peddapuram. The said suit was filed for recovery of mortgage debt and the same was decreed on
13.02.2023. Aggrieved by the judgment and decree dated 13.02.2023, the respondents / defendants preferred the above mentioned appeal. Be that as it may. 4.
Learned counsel for the petitioner drawing the attention of this Court to the docket proceedings, made submissions inter alia that the appeal filed by the respondents / defendants is being adjourned from 18.06.2025 onwards at their request and in view of the same, the petitioner / plaintiff / decree holder is deprived of enjoying the fruits of the decree. He submits that unless a direction is issued for disposal of the appeal, the petitioner would suffer serious prejudice and irreparable loss. 5. Considered the submissions made. As seen from the docket proceedings, it would appear that the arguments were already heard and the matter was posted for judgment on 22.07.2025. From a reading of the proceedings dated 10.09.2025, it would appear that the matter was directed to be listed on 26.09.2025 for counter in I.A.No.144 of 2023 and hearing. No

details are forthcoming with reference to the said I.A.No.144 of 2023. Be that as it may. On a perusal of the docket proceedings, it cannot be viewed that the matter is being adjourned at the instance of the respondents / appellants / defendants. Be that as it may. 6. On a perusal of the material available on record, it is evident that the learned District Judge is keen to dispose of the appeal. In such circumstances, though no specific direction be issued, in the light of the submission that the petitioner / plaintiff is deprived of enjoying the fruits of decree, the Revision Petition is disposed of, providing that the learned District Judge shall make endeavour to dispose of A.S.No.65 of 2023, strictly in accordance with the Law, as expeditiously as possible.
