02/ 17.12.2025: Heard learned counsel for the petitioner and learned counsel for the State. 2. The petitioner is apprehending her arrest in connection with Ramna P.S. Case No.84 of 2025, registered for the offence under Sections 406, 409 and 420/34 of the I.P.C., pending in the Court of the learned Judicial Magistrate, 1st Class, Nagar Untari, Garhwa. 3. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in the case. He further submits that the allegation has been made that by way of fraud, the petitioner has obtained Rs.2,00,000/- for constructing the house under Abua Awas Scheme. He then submits that the enquiry was done by the competent authority and, thereafter, the said payment has been made. He next submits that the petitioner will cooperate in the investigation. He submits that co-accused has been granted anticipatory bail in A.B.A. No. 7063 of 2025 in view of that, the prayer for anticipatory bail may kindly be allowed. 4. Learned counsel appearing for the State opposed the prayer and submits that notice has been issued to the petitioner to return the said amount, however, the petitioner has not returned the amount. 5. amount has been released in favour of the petitioner and it has been pointed out that the construction of house has already been completed and co- accused has been granted anticipatory bail in the aforesaid A.B.A and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. 6.
Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of her arrest or surrender, she shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Nagar Untari, Garhwa in connection with Ramna P.S. Case No.84 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Dt.17.12.2025
