The present Revision Petition is filed seeking a direction for disposal of appeal A.S.No.40 of 2023 on the file of the Court of Senior Civil Judge, Ramachandrapuram under Article 227 of the Constitution of India. 3. The appellant in the above said appeal is the plaintiff in O.S.No.110 of 2010 on the file of the Court of Junior Civil Judge, Anaparthi. The said suit was filed for recovery of amount on the foot of a Pronote and the same was decreed on 17.07.2023. Aggrieved by the judgment and decree dated 17.07.2023, the respondent / defendant preferred the above mentioned appeal. Be that as it may. 4. Learned counsel for the petitioner drawing the attention of this Court to the docket proceedings of the appellate Court, made submissions inter alia that the appeal filed by the respondent / defendant is being adjourned from time to time at his request and in view of the same, the petitioner / plaintiff / decree holder is deprived of enjoying the fruits of the decree. He submits that unless a direction is issued for disposal of the appeal, the petitioner would suffer serious prejudice and irreparable loss. 5. Considered the submissions made. As seen from the docket proceedings of the appellate Court, it appears that the matter is being adjourned at the request made on behalf of the respondent / appellant / defendant from 30.09.2024 onwards. Be that as it may. As the appeal is preferred against a money decree, the Revision Petition is disposed of, 3 providing that the learned Senior Civil Judge shall make endeavour to dispose of the appeal A.S.No.40 of 2023, as expeditiously possible, preferably within a period of six months from the date of receipt of a copy of this order. No order as to costs.
