[2025:RJ-JP:4394] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 606/2025 1. Irfan S/o Ibrahim, Aged About 38 Years, R/o Ghaghwadi, Police Station Kaithwada, District Deeg. 2. Jayram S/o Phoolsingh, Aged About 21 Years, R/o Udaka, Police Station Kaman, District Deeg. (At Present Accused Petitioners Confined In Sub Jail, Deeg). ----Petitioners Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Rahul Sinsinwar For Respondent(s) : Mr. Jitendra Singh Rathore, Addl.G.A. HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 31/01/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No. 224/2024 registered at Police Station Kaithwada, District Deeg for the offence under Sections 303(2), 317(2), 319(2), 318(4), 338, 336(3), 340(2), 308(2) and 61(2)(a) of BNS and Section 66 of IT Act. Learned counsel for the petitioners submits that the accused petitioners have falsely been implicated in this case. Counsel further submits that offences alleged to have been committed by the petitioners are triable by Magistrate. The accused-petitioners are in custody since 19.12.2024 and there is no criminal antecedents against the petitioners, the trial of the case may take [2025:RJ-JP:4394] (2 of 2) [CRLMB-606/2025] considerable time, therefore, the petitioners may be enlarged on bail. Per contra, learned Public Prosecutor opposes the grant of bail application. Heard and perused the material available on the record. Considering the arguments advanced by the counsel for the parties and looking to the fact that the case of the petitioners is triable by Magistrate, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused- petitioners on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioners 1. Irfan S/o Ibrahim, and 2. Jayram S/o Phoolsingh, in connection with FIR No. 224/2024 registered at Police Station Kaithwada, District Deeg shall be enlarged on bail provided each of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so.
