LAKSHMANA RAO CRIMINAL PETITION NO: 9673/2025 The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity [the BNSS'), seeking to enlarge the petitioner/sole Accused on bail in Crime.No.45 of 2025 of Budarayavalasa Police Station, Vizianagaram District, registered for the offences punishable under Sections 75 (1), 78(1)(i), 351 (2),108 read with 62 ofBNSS. 2. The case of the prosecution is that the petitioner/sole accused outraged the modesty of the cfe facfo-complainant by way of stalking coupled with physical contacts and advances involving unwelcoming acts that occurred on 06.08.2025 at Siridevipuram Village, she with an intention to die consumed the phenyl in their bathroom. Basing on the statement of the victim, crime No.45 of 2025 has been registered against the petitioner in Budarayavalasa Police Station. 3. The learned counsel for the petitioner contends that the petitioner is innocent of the alleged offence and has been falsely implicated by the police. lt is further submitted that the petitioner is the sole earni,ng member of the family and, therefore, his incarceratl'on would cause undue hardship to his dependents. The petitioner undertakes to strictly adhere to any conditions that Ep c£'n -gr may be imposed by this Court. ln light of the foregoing submissions, learned counsel prays that the present petition be allowed in the interest of justice. 4. Per cot,ira, Ms.P.Akhila Naidu, the learned Assistant Public Prosecutor vehemently opposed the grant of bail to the petitioner, submitting that the investigation is still underway and several material witnesses remain to be examined. It is contended that if the petitioner is released on bail at this stage, there is a strong likelihood that he may abscond, thereby hampering the ongoing investigation and evading the process of law. ln view of the foregoing submissions, it is urged that the petI'tiOn be dismissed. 5. Heard Sri B.Rama Shankar Rao, learned counsel for the petitioner, Sri Prabhakar Rao, learned Legal Aid Counsel for respondent No.1 and the learned Assistant Public Prosecutor. Perused the record. 6. As seen from the record, the allegation against the petitioner is that he outraged the modesty of the victim who is aged about 21 years and she got recently married. Petitioner was arrested on 09.08.2025. He has been in judicial custody for the past 59 days. The learned Assistant Public Prosecutor submits that so far four witnesses have been examined by the investigating officer. ln this type of cases, examination of the four witnesses who are all eye witnesses and material witnesses, it can be said that the substantial question of investigation is completed. Considering the entire gamut of the case, the nature and gravity of the allegations levelled against the petitioner, stage of the investigation, and the period of detention undergone by the petitioner in judicial custody for the past 59 days, this Court is inclined to enlarge the petitioner on bail with the following stringent conditions: i. The petitioner/sole Accused shall be enlarged on bail subject to he executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties for the like sum each to the satisfaction of the learned Principal District & Sessions Judge, Vizianagaram. li. The petitioner/sole Accused shall appear before the Station House Officer concerned on every Saturday in between 10:00 am and 05:00 pm, till cognizance is taken by the learned Trial Court. iii. The petitioner/sole Accused shall not leave the limits of the District without prior permission from the Station House Officer concerned. iv. The petitioner/sole Accused shall not commit or indulge in commission of any offence in future. i_. \\ v. The petitioner/sole Accused shall cooperate with the investigating officer in further investigation of the case and shall make himself available for interrogation by the investigating officer as and when required. vi. The petitioner/sole Accused shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the court or to any police officer. 9.
