Learned counsel for the petitioner would submit that the petitioner has challenged the order dated 11-04-2025 (Annexure-P/1) by which she has been de-attached from SHQ BSF Raipur and posted at CH Kolkata. He would further submit that the petitioner is working as Inspector Nursing Staff. Digitally signed by MOHAMMAD AADIL KHAN 2 Though, earlier she was adjusted at SHQ BSF Raipur, but at that time she was carrying pregnancy and now recently she delivered a baby child on 15- 03-2025 and considering the six month’s old baby child on her lap it would be very difficult for her to go on her duty at Kolkata. Therefore, some breathing time may be granted to take care of her baby child and not to disturb her place of posting at this stage. He would also submit that the petitioner is ready and willing to make her representation to the authorities concerned and the authorities concerned may be directed to consider her representation in accordance with law considering her difficulties. 2. On the other hand, learned counsel for the respondents would, on instruction, submit that earlier the petitioner was accommodated on the ground of her pregnancy at Raipur and now, she again came for her accommodation on the same ground. It is for the authorities concerned in view of the exigency of the work as to whether the petitioner be posted at Raipur or Kolkata. However, if the petitioner would move a representation to the authorities concerned, it will be decided in accordance with law as early as possible. 3. I have heard learned counsel for the parties and perused the material annexed with the petition. 4. Considering the submissions made by the counsel for the parties and the issue involved in the matter, the petitioner is directed to make her representation before respondent No.1 within two weeks from the date of receipt of copy of this order and if such representation is made respondent No.1 shall decide the representation of the petitioner considering her grievances within a further period of six weeks from the date of receipt of the representation in accordance with law on its own merits. Till the representation of the petitioner is decided the impugned de-attachment order dated 11-04-2025 with respect to the petitioner’s de-attachment be kept in abeyance. 3 5.
