This criminal jail appeal has been preferred by the appellant through Senior Superintendent, Sub- District, Jail, Haldwani, District Nainital against the judgment and order dated 12.02.2020, passed by learned Special Judge (Gangster Act), Nainital in Special Sessions Trial No.25 of 2019, State vs. Irshad Ali, whereby the appellant has been convicted under Section 2/3 of the U.P. Gangsters and Anti-Social Activities (Prevention) Act, 1986 (as applicable in the State of Uttarakhand) and sentenced to undergo two years’ imprisonment with fine of Rs.5,000/- with default stipulation of one month additional imprisonment. 4. Vide order dated 03.09.2025, learned State Counsel was directed to bring on record the custody report of the appellant. 5. Today, learned State Counsel supplied instructions dated 04.09.2025 to the Court, which have been taken on record. On instructions, he submits that the appellant has already served out the sentence 2 imposed upon him and he has been released accordingly. 6. Since there is no one to press the appeal on merits, therefore, the present criminal jail appeal is dismissed as infructuous as the appellant has served out the sentence imposed.
