GP FOR HOUSING 2 THE HON’BLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No.25385 OF 2024 ORDER: The Writ Petition is filed questioning the inaction of the respondents in releasing the pending bill amounts of Rs.93,11,566/- to the Petitioner for the works executed as under: (i) Kavali Municipality-Temporary Water Supply- Navaratnalu Pedalandariki ILLU- Providing borewells and feeder pipeline from irrigation tank near chowdarypalem to musunur layouts ID No.098101LA113975 BED College and ID 098116LA000303 (34.ACs) Kavali Municipality Limits (ii) Providing Temporary Water Supply Construction Activity under Pedalandarii ILLU in musunur (16th ward) (Layout ID-098116LA000305) Part IV (1555 Plots) in Kavali Municipality., (iii) Providing Temporary Water Supply Construction Activity under Pedalandarii ILLU at musunur (16th ward) (Layout ID- 098116LA000305 ) Part III in Kavali Municipality, vide Agreement Nos.8/2022-23, dated 18.04.2022, 7/2022-23, dated 18.04.2022, 6/2022-23, dated 18.04.2022. 2. The learned counsel for the Petitioner submits that he had executed the works under the agreement Nos. 8/2022-23, dated 18.04.2022, 7/2022-23, dated 18.04.2022, 6/2022-23, dated 3 18.04.2022, and an amount of total Rs. 93,11,566/-, is due under the respective agreements. 3. A counter affidavit was filed by the Respondent Nos.3 & 5, wherein, it was stated that the Superintendent Engineer, Public Health, Nellore has recorded the value of work done in the M- Books as Rs.93,11,566/- and has submitted a letter vide Lr.No.A1/NPI/TWS/Kavali/2024, dated 28.06.2024 to the District Head Housing, APSHCL, SPSR Nellore, requesting for release of said amount. The District Head Housing, Nellore vide Rc.No.897/Water Supply/NPI/AM(E)-I/2020, dated 21.11.2024 had addressed a letter to the Managing Director APSHCL, Nellore with a request to release funds for the works executed by the Petitioner. 4. It is further stated that re-verification of M-Books is also undertaken and after completion of the re-verification and sanctioning of the amounts, pending bills of the Petitioner will be released. 5. Heard the learned counsel for the Petitioner and the learned counsel for the Respondent Nos.3 & 5. 6. In view of the aforesaid submissions and also considering the fact that there is no dispute with regard to the execution of 4 works, this Court is inclined to dispose of the Writ Petition with following direction: (i) The Respondents are directed to complete re-verification of the works done by the Petitioner, within a period of six (06) weeks from today and release the amounts due, to the petitioner within a period of three (03) months, thereafter.
