“10.(i) That, this Hon'ble Court may kindly be pleased to call for the entire records pertaining to the petitioner's case. (ii) That, this Hon'ble Court may kindly be pleased to set-aside impugned order dated 13.02.2020 (Annexure P-1) passed by the learned First Additional Sessions Judge Sakti, District Janjgir Champa Chhattisgarh, in the Digitally signed by NADIM MOHLE

(iii) That, this Hon'ble Court may kindly be pleased to punish the respondents under section 427, 430/34 of the Indian Penal Code as damaged and destroyed of the property of the petitioner committed by the respondents, in the interest of justice. (iv) Any other relief which may be suitable in the facts and circumstances of the case including cost of the petition, may also be granted.” 2) From a perusal of the order dated 13.02.2020, it is apparent that on a prayer of the petitioner, appeal was dismissed. In this writ petition, the petitioner has also sought relief to take action against respondents according to the provisions of Section 427, 430/34 of the Indian Penal Code. 3) It appears that the proceedings of appeal was terminated on request of the petitioner himself, therefore, the relief No. 10.ii cannot be granted to the petitioner. 4) With regard to relief No.10.iii, the petitioner would be at liberty to file a complaint case before the competent Court. 5) With the aforesaid observation, this writ petition is hereby disposed of.
