GP FOR FINANCE PLANNING 2 THE HON’BLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No.25290 OF 2024 ORDER: The Writ Petition is filed questioning the inaction of the respondents in releasing the pending bill amounts of Rs.41,69,989/- to the Petitioner for the works executed as under: (i) Providing Temporary Water Supply Construction Activity under Pedalandarii ILLU at Kondlapudi- 61.00 acre (Layout ID- 098240LA001331) Part 1 in Nellore.,(ii) Providing Temporary Water Supply Construction Activity under Pedalandarii ILLU at Kondlapudi- 61.00 Acre (layout ID-098240LA001331) Part II in Nellore. (iii) Providing Temporary Water Supply Construction Activity under Pedalandarii ILLU at Kondlapudi- 61.00 Acre (Layout ID-098240LA001331) Part III in Nellore., (iv) Providing Temporary Water Supply Construction Activity Under Pedalandarii ILLU in budamgunta (17th Ward) –(Layout ID- 098116LA001439)(1182) in Kavali Muncipality in Nellore., (v) Providing Temporary Water Supply Construction Activity under Pedalandarii ILLU in Musunur (16th ward) – (Layout ID-098116LA000305)-Part II in Kavali Municipality vide Agreement Nos.1/2022-23, dated 18.04.2022, 2/2022-23, dated 18.04.2022, 3/2022-23, dated 18.04.2022, 4/2022-2023, 5/2022-2023, dated 18.04.2022. 3 2. The learned counsel for the Petitioner submits that he had executed the works under the agreement Nos. 1/2022-23, dated 18.04.2022, 2/2022-23, dated 18.04.2022, 3/2022-23, dated 18.04.2022, 4/2022-2023, 5/2022-2023, dated 18.04.2022, and an amount of total Rs.41,69,989/-, is due under the respective agreements. 3. A counter affidavit was filed by the Respondent No.5, wherein, it was stated that the executive Engineer, Public Health, Nellore has recorded the value of work done in the M-Books as Rs.41,49,989/- and has submitted a letter vide Lr.No.NPI/T.W.S/Nellore/2024/515m, dated 09.09.2024 to the District Head Housing, APSHCL, SPSR Nellore., requesting for release of said amount. The District Head Housing, Nellore vide Rc.No.897/Water Supply/NPI/AM(E)-I/2020, dated 25.10.2024 had submitted a proposal to Managing Director APSHCL, Nellore with a request to release funds for the works executed by the Petitioner. 4. It is further stated that re-verification of M-Books is also undertaken and after completion of the re-verification and sanctioning of the amounts, pending bills of the Petitioner will be released. 4 5. Heard the learned counsel for the Petitioner and the learned counsel for the Respondent No.5. 6. In view of the aforesaid submissions and also considering the fact that there is no dispute with regard to the execution of works, this Court is inclined to dispose of the Writ Petition with the following direction; (i) The Respondents are directed to complete the re- verification of the works done by the Petitioner, within a period of six (06) weeks from today and release the amounts due, to the petitioner within a period of three (03) months, thereafter.
