IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA
CWP No.19849 of 2025 Date of Decision: 16.12.2025 _______________________________________________________ Ram Singh
…….Petitioner
Versus
Himachal Road Transport Corporation & others … Respondents _______________________________________________________
Coram: Hon’ble Mr. Justice Sandeep Sharma, Judge. Whether approved for reporting? 1
For the Petitioner: Mr. Rakesh Kumar Sharma & Mr. Arun
Rana, Advocates.
For the Respondents: Mr. Virender Singh Kanwar, Advocate. ____________________________________________________ Sandeep Sharma, Judge(oral):
Petitioner herein is aggrieved of order dated 10.12.2025 (Annexure P-3), whereby he has been transferred from Reckong Peo Unit to Hamirpur Unit.
2.
Precisely, the facts of the case as emerge from the pleadings adduced on record by the petitioner, which are duly supported by the affidavit reveals that petitioner herein had been working at Reckong Peo w.e.f.27.10.2022. Since petitioner had completed normal tenure of posting in hard/tribal area, he preferred representation, praying therein for his transfer to one of the stations of his choice i.e. Bilaspur. Though, respondents accepting the aforesaid request made by the petitioner passed order dated 04.12.2025 (Annexure P-2), thereby transferring him from Reckong Peo to Bilaspur Unit, but within a period of six days aforesaid order was

superseded vide order dated 10.12.2025, whereby petitioner has been transferred from Reckong Peo Unit to Hamirpur Unit.
3.
In nutshell, the grouse of the petitioner as has been highlighted in the petition and further canvassed by learned counsel for the petitioner, is that since petitioner after his having served in hard/tribal area for prescribed period was entitled to be given stations of his choice and such, prayer of him was acceded to by the respondents, while passing order dated 04.12.2025, thereby transferring the petitioner to Bilaspur, there was no occasion, if any, for the respondents to pass impugned order dated 10.12.2025, thereby transferring petitioner from Reckong Peo Unit to Hamirpur Unit.
4.
Learned counsel for the petitioner, on instructions, states that though petitioner is entitled to be posted at Bilaspur, but in case there is some difficulty in posting the petitioner at Bilaspur, he has filed representation dated 11.12.2025 (Annexure P-4), whereby prayer has been made for his adjustment at one of the stations, as given in the representation.
5.
While putting in appearance on behalf of the respondents, Mr. Virender Singh Kanwar, Advocate fairly admits that petitioner ought not have been disturbed from Bilaspur on account of his having already worked in hard/tribal area for more than prescribed

period. He states that representation dated 11.12.2025 filed by the petitioner shall be decided expeditiously.
6.
Consequently, in view of the fair stand adopted by
learned counsel for the respondents, the present petition is disposed of with a direction to the respondents to consider and decide the pending representation dated 11.12.2025(Annexure P-4) of the petitioner expeditiously, preferably within a period of two weeks. Needless to say, authority concerned, while doing the needful in terms of instant order, shall afford an opportunity of being heard to the petitioner and pass appropriate order, taking note of the fact that petitioner has already completed normal tenure of posting in hard/tribal area and as such, he is entitled to be posted at one station of his choice. Till the time representation is not decided by the competent authority, petitioner shall not be compelled to join at Hamirpur. Pending applications, if any, also stand disposed of.
