CORAM : THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE RAVI CHEEMALAPATI DATE : 24th September 2025 P C : The issue that has been highlighted in the present Public Interest Litigation is with regard to the alleged encroachment of a lake called ‘Uppucheruvu’ admeasuring Ac.2-84 cents in Sy.No.54 of Kothota Village, Mogalturu Mandal, West Godavari District. 2. It is stated that no action has been taken by the District Collector as also the Revenue Divisional Officer despite number of complaints having been filed in that regard. 3. The issue with regard to encroachment of lakes and water bodies has more elaborately been dealt with by this Court and directions have been issued in W.P(PIL).No.140 of 2022 and batch. 2 4. We accordingly dispose of this petition in terms of the directions issued in W.P(PIL).No.140 of 2022 and batch and direct the District Collector, West Godavari District at Bhimavaram as also the panchayat authorities to take necessary remedial measures and in case it is found that there is any encroachment by any person unauthorisedly over the water body in question, then, appropriate action be taken in accordance with law after giving to the parties concerned an opportunity of hearing. The concerned authorities, if required, may seek such information from the petitioner as they may feel fit in the facts and circumstances of the case with a view to identify the nature of encroachment which has been alleged in the present petition.
