On earlier occasion, notices have been issued vide order dated 05.08.2025 and thereafter specific direction was also issued on dated 08.09.2025 in respect of receiving statement from the opposite party no.2 for ascertaining the facts, which has been mentioned through instant application that the amount so received by the applicant has already been refunded to opposite party no.2 or not? 3. In reply to the above, a specific report through Government Advocate has been submitted by Sub-Inspector, Omveer Singh, P.S. Indrapuram, Commissionerate Ghaziabad, wherein it is specifically mentioned that Nimish Kataria, opposite party no.2 has already received Rs.70,000/- and he is not interested to get any proceedings continue against the applicant. 4. In view of the settlement of dispute which was only to the tune of Rs.70,000/- , the entire proceedings initiated against the applicant in shape of Case No.73207 of 2024 (State vs. Subham Sahu) arising out of Case Crime No.1754 of 2023, under section 66D of I.T. Act, P.S. Indrapuram, District- Ghaziabad, pending in the court of learned Chief Judicial Magistrate, Ghaziabad, including charge-sheet dated 20.07.2024 along with cognizance/summoning order dated 04.12.2024, is hereby quashed. 5.
