Learned advocate for the petitioner is present. 2. This application under Section 227 of the Constitution is filed with a prayer for directing the learned Judicial Magistrate, First Court at Barrakpore, District- 24 Parganas (North) to dispose of Misc. Case No. 687 of 2020 filed under Section 125 of the Code of Criminal Procedure expeditiously. 3. Learned advocate for the petitioner submits that although the opposite party no. 1 has instituted the application under Section 125 Cr.P.C in the year 2020 but the same is not disposed of till today and the petitioner is continuing to pay interim maintenance to the opposite party no. 1. Learned advocate submits that for this long period no evidence is taken by the learned Trial Court. 4. In the facts and circumstances of the case, this Court is of the view that no fruitful purpose will be 2 served by keeping this matter pending and directing service of notice upon the opposite parties. Thus, this application is disposed of with request upon learned Judicial Magistrate, 1st Court at Barrackpore, District- 24 Parganas (North) to dispose of Misc. Case No. 687 of 2020 within a period of 3 months from the next date fixed without granting any unnecessary adjournment. (Biswaroop Chowdhury, J.)
