1. This is the third bail application of the applicant filed under section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023. The first bail application was dismissed as withdrawn after arguing for some time vide order dated 14.06.2024 passed in MCRC No. 3122 of 2024. The second bail application of the applicant was again dismissed as withdrawn after arguing for some time vide order dated 01.10.2024 passed in MCRC No. 6648 of 2024. Learned counsel for the applicant would submit that the elder sister of the applicant, Smt. Tijanbai Joshi, has expired on 05.01.2024 and he has to appear in her last rites. Therefore, the applicant may be released on interim bail for 5 days, for which he has moved this third bail application.

Learned counsel for the State would submit that the learned trial Court has already passed an order on 08.01.2025 permitting the applicant to appear on 10th day rites of the deceased, which is to be on 14.01.2025. Therefore, there is no need to release the applicant on interim bail.

Considering the submissions made by learned counsel for the parties, considering the facts and circumstances of the case and also after perusal of the document annexed with the application, it reflects from the order dated 08.01.2025 passed by learned trial Court that the applicant has already permitted to appear on 14.01.2025 in her 10th day rites in police custody. I am not inclined to release the applicant on interim bail. Therefore, his application for grant of interim bail I.A .No. 1 of 2025 is rejected.
5. There is no change in circumstance in the case after dismissal of the second bail application of the applicant on 01.10.2024 and no ground has been raised with that respect. Therefore, I do not found sufficient ground to admit the third bail application and therefore the same is hereby dismissed at the motion stage itself. Sd/- (Ravindra Kumar Agrawal) Judge ved
