BY ADV DEEPU THANKAN THIS WRIT PETITION (CIVIL) HAVING COME UP FOR ADMISSION ON 01.04.2025, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING:
2025:KER:29012 WP(C) NO. 3683 OF 2025 2 D. K. SINGH, J ---------------------------------------------- WP(C) No. 3683 of 2025 ---------------------------------------------- Dated this the 01st day of April, 2025 J U D G M E N T The petitioner is an Empanelled Driver of the Kerala State Road Transport Corporation in Idukki district. On 10.08.2024, the petitioner was performing duties as a conductor in the KSRTC bus traveling from Manakkadavu to Ponkunnam. A separate inspection was conducted in the bus on the said day, during which five bottles of foreign liquors (750 ml each) were found beneath the seat of the conductor. Since then, the petitioner has not been given any duties, and the driver who was on the wheel has been subjected to disciplinary proceedings. 3. Considering the aforesaid allegations, I do not find that the respondents had committed any error in not giving duty to the petitioner. The petitioner has filed this writ petition for following prayers:
2025:KER:29012 WP(C) NO. 3683 OF 2025 3 (i) “To issue a writ of mandamus or other writ or order directing the 2nd respondent to permit the petitioner to rejoin duty as Empanelled Driver with the 2nd respondent; (ii) To issue a writ of mandamus or other writ or order directing the 2nd respondent to consider and pass orders on Exhibit- P3”. 4.
I am of the considered view that the writ petitioner is not entitled to the duty, and therefore, the relief sought therein, commanding the respondent to assign him duty, is unwarranted. The
petitioner
has submitted the representation in Ext.P3 before the 2nd respondent. However, the present writ petition is disposed of with a direction to the 2nd respondent to consider the Ext.P3 representation filed by the petitioner. Sd/- D. K. SINGH JUDGE mea
