The Petitioner is working as a Computer instructor at Kasturiba Gandhi Balika Vidyalaya (KGBV) on payment of Rs.250/- The Petitioner had obtained B.P.Ed-Methodology of per class. Physical Education from Sri Krishnadevaraya University in February In the examination conducted pursuant to the DSC 2015. Notification, 2025, the Petitioner had secured 75 marks with Rank of 107 and earned a place in the merit list under the BC-A Category. Thereafter, she was called for certificate verification on 28.08.2025 at Anantapur, and in the certificate verification, she had submitted all the documents required. Thereupon, the Petitioner’s appointment was withheld on the basis of a complaint said to have been made against her qualifications. Hence, the present Writ Petition. 2 3. Heard Smt. Kavitha Gottipati, learned counsel for the Petitioner and Sri G. Ramachandra Pleader for Services-11 Rao, learned Government 4. Learned counsel for the Petitioner worked as per the instructions of KGBV, payment of Rs.250/- per class and the the category of outsourcing/contract basis was issued. Having heard the respective counsel, there i fact that the Petitioner IS no dispute to the secured B.P.Ed qualification from Sri Knshnadevaraya University and is entitled to be appointed on the 3 that she has obtained in the DSC Examinations, 2025. The rejection of the candidature of the Petitioner on account of not obtaining a ‘No Objection Certificate’ from where she was working may not be a serious disqualification. Apart from that, the Petitioner is not a full time employee as she was being paid on hourly basis. As the Petitioner is not a full time employee, the Respondents Therefore, this score cannot void considering the Petitioner on merit. Court is of the opinion that as long as the Petitioner has the requisite qualification for being appointed as School Assistant as per the DSC Notification, 2025, the candidature of the Petitioner cannot be rejected. Hence, the present Writ Petition is disposed of with the 7. following directions; (i) The Respondent Authorities are directed to consider the case of the Petitioner for recruitment to the post of School Assistant (Physical Education) in the light of her qualifications and marks secured in the DSC examination, 2025.
