ORDER: This writ petition is filed questioning the transfer proceedings No.E4/142/2024/Transfers dated 22.09.2024 issued by Respondent No.3 in contravention of G.O.Ms.No.75, Finance (HR).(i)-pg and Policy Department dated 17.08.2024 as illegal and arbitrary.
2. The petitioner was worked as a typist in RWS & S, Sub- The 3'"^ respondent vide proceedings No.E4/142/2024/Transfers dated 22.09.2024 transferred the Petitioner from RWS & S Division, Anakapalle and posted as Senior Assistant in the Office DREO, Paderu. Division, Paderu.
Learned counsel for the Petitioner contends that the Petitioner was previously worked in agency area in Paderu for more than 2 years i.e. from 01.02.2017 to 12.07.2019 and again posting in agency area is contrary to the guidelines issued vide G.O.i\/ls.No.75 dated 17.08.2024. Further, it is the plea of the Petitioner that he is suffering from medical ailments and therefore, the order of transfer should be reconsidered.

4. Sri S.Raju, learned Assistant Government Pleader would submit that the Petitioner was relieved from Anakapalle on 27.09.2024 and has joined in Paderu. He further submits that transfer being an incident of service, the Petitioner cannot insist for staying at a particular place.
5. Having heard the respective counsel, this Court is of the opinion that it is well known that transfer is an incident of service and the guidelines issued for transfer cannot be enforced under Article 226 of the Constitution of India.
6. Therefore, this Court is not inclined to interfere with the
order of transfer. However, considering the plea of the Petitioner that he is suffering from medical ailments, the writ petition is
disposed of with following directions: (i) The Petitioner shall submit a representation to the Respondent-authorities within a period of four weeks from today and the same may be considered after examining the medical records. (ii) No order as to costs.
3 As a sequel, the miscellaneous petitions if any shall stand dismissed.
