Also heard Mr. K Baishya, the learned Additional Public Prosecutor for the State of Assam. 2. Ms. R Choudhury, the learned Amicus Curiae for the respondent No.2 is absent on call. 3. This is an application under Section 430 (2) of the BNSS, 2023 praying for suspension of sentence and for allowing the applicant to go on bail. 4. The applicant was sentenced to undergo rigorous imprisonment for five years and also to pay fine of ₹10,000/- by the learned Additional Sessions Judge-cum-Special Judge (POCSO), Sivasagar in Special (POCSO) Case No.26/2019. 5. I have gone through the judgment passed by the trial court. I have also considered the submissions made by the learned counsels of both sides. 6. It is hereby directed that the sentence imposed upon the applicant, Md. Rumid Ali by Page No.# 3/3 the learned Additional Sessions Judge-cum-Special Judge (POCSO), Sivasagar in Special (POCSO) Case No.26/2019 shall remain suspended till disposal of the connected appeal. 7. The applicant, namely, Md. Rumid Ali is allowed to go on bail of ₹25,000/- (Rupees Twenty Five Thousand) with a surety of like amount to the satisfaction of the learned Additional Sessions Judge-cum-Special Judge (POCSO), Sivasagar. 8.
