Neutral Citation No. - 2025:AHC:50519-DB Court No. - 3 Case :- WRIT - C No. - 8850 of 2025 Petitioner :- M/S. Pass Enterprises Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Mani Ram Verma Counsel for Respondent :- Ashok Kumar Tiwari,C.S.C. Hon'ble Anjani Kumar Mishra,J. Hon'ble Jayant Banerji,J. 1. Heard learned counsel for the petitioner and learned counsel appearing for the Nagar Panchayat. 2. This petition has been filed after delay that is reported to be of 405 days challenging the order dated 21.10.2023 and recovery notice dated 10.11.2023. 3. A perusal of the order dated 21.10.2023 reflects that by means of that order, the contract for taxi stand for the period from 1.4.2023 till 31.3.2024 that was granted in favour of the petitioner was cancelled. The consequential recovery notice dated 10.11.2023 has been issued to the petitioner for recovery of the dues of the Nagar Panchayat for the period for which the contract for taxi stand existed in favour of the petitioner. 4. In our considered opinion, the petitioner seeks to raise disputed questions of fact which would involve recording of evidence and impleadment of other necessary parties, if any, which can be done in a civil suit. 5. For the reasons aforesaid, interference in the petition is declined and this petition is dismissed. Order Date :- 8.4.2025 A. V. Singh Digitally signed by :- AJAY VIKRAM SINGH High Court of Judicature at Allahabad
