Order 19/02/2025
1. The instant bail application has been filed under Section 483 of BNSS on behalf of the petitioner, who has been arrested in connection with FIR No.92/2001 registered at Police Station Todabheem, District Karauli for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 302 & 447 of IPC.
2.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is submitted that there is no allegation against the petitioner to cause injury on the person of deceased. It is submitted that number of persons were charge- sheeted in this case and other accused persons were acquitted by learned trial court. Some of the persons have been convicted and appeal preferred by them is pending before this Court. It is contended that petitioner is in custody since 17.07.2024. Further
[2025:RJ-JP:7442] (2 of 2) [CRLMB-14084/2024] custody of the petitioner would not serve any fruitful purpose. Trial will take considerable time in its conclusion.
3. Learned Public Prosecutor opposes the submissions made by counsel for the petitioner. He submits that the matter pertains to year 2001 and since then, petitioner was absconding. Now, he has been arrested in the month of July 2024. It is submitted that there is specific allegation against the petitioner that he caused firearm injury on the leg of injured Damu which shows that he actively participated in commission of crime.
4. I have considered the contentions.
5. Considering the fact that petitioner remained absconded for about 23 years; he caused firearm injury on the leg of injured Damu as also considering the role attributed to the petitioner, this Court is not inclined to enlarge the petitioner on bail.
6. Accordingly, the instant bail application is dismissed.
7. Learned trial court is requested to expedite the trial.
