Petitioner is permitted to implead District Magistrate, Agra as respondent no.4 in the array of parties to the writ petition. Notice on behalf of newly impleaded respondent is accepted by learned Standing Counsel. It appears that petitioner had availed of loan from the respondent bank, which has been repaid and no dues certificate has also been issued by the bank on 9.8.2023. It is argued that endorsement made in the revenue records creating charge in respect of certain property, however, is not being removed by the revenue authorities. It is submitted that the bank has no objection, yet the concerned revenue authority is keeping the matter pending. In the facts of the case, we permit the petitioner to approach the fourth respondent, alongwith materials indicating that petitioner has already repaid the loan and there is no charge on his property of the bank. The District Magistrate concerned would issue necessary direction to the second respondent to ensure that appropriate steps, as are required in law, are taken to effect necessary endorsement in the revenue records. Such action would be taken within a period of two months from the date of presentation of a certified copy of this order.
