The petitioner has sought the present petition under Section 528 of BNSS, 2023 for issuance of direction to the learned Judicial Magistrate First Class Katghora, District- Korba, C.G. to decide the pending unregistered complaint case expeditiously within prescribed time limit, in the interest of justice. 2 2. The subject matter in brief is that on 16.12.2020 the sone of Amit solemnized marriage with the Yashvini Vasitthi (respondent no. 1) according to Hindu Custom and on 11.05.2022 the respondent no. 1 left her matrimonial house and started residing at her parental house. On 22.02.2023 at about 10:25 pm suddenly father-in- law of the applicant entered into the house of applicant with weapon and unnecessarily started quarreling and assaulted the applicant. On 27.03.2023 the applicant made a written complaint to the concerned police station Katghora, District- Korba, C.G. as well as Sub Divisional Officer but no action has been taken by the concerned authorities. Thereafter the applicant has filed an application under Section 156(3) of Cr.P.C. before the JMFC, Katghora, District- Korba, C.G. on 17.05.2023 for seeking direction to the concerned police station Katghora to register the offence under Section 452, 294, 506 of IPC against the respondents. Since then, the proceedings is going on and has not been completed till today. 3. Learned counsel for the petitioner contended that the complaint case has been filed on 17.05.2023 and till date the same is still pending before the Judicial Magistrate First Class, Katghora and prays for issuance of direction to expedite the trial in the interest of justice. 4. I have heard learned counsel for the petitioner and perused the record with utmost circumspection. 5. Perusal of record shows that the applicant has preferred an application under Section 156(3) of Cr.P.C. before the JMFC, Katghora, District- Korba, C.G. (Annexure P/1) on 17.05.2023 for seeking direction to the concerned police station Katghora to register the offence under Section 452, 294, 506 of IPC against the respondents but the same has not been decided by the learned JMFC, Katghora till today. 6. Looking to the limited grievance of the petitioner, this Court directs the Judicial Magistrate First Class, Katghora, District- Korba, C.G. to decide the pending unregistered complaint case expeditiously as soon as possible. 7.
